Terms and Conditions of Service

1. Acceptance of Terms
By choosing to work with Elevare Agency, accessing our website, or signing any proposal or agreement, you agree to these Terms and Conditions. If anything is unclear or doesn’t feel right to you, we encourage you to reach out before proceeding, we’re always happy to clarify.
2. Description of Services
Elevare Agency offers a range of digital marketing services, including social media management, content creation, paid advertising (Meta Ads, Google Ads), strategy and web development, SEO and content.. The specific services you choose will always be clearly outlined in your proposal or agreement.
3. Proposals and Contracts
Every collaboration begins with a written proposal that details the scope, deliverables, timelines, and fees. We’ll only begin once you’ve reviewed and approved everything, ensuring we’re fully aligned from the start. Approval can be provided via digital signature, or a signed document.
4. Fees and Payments
4.1 All fees will be clearly stated in your approved proposal, no surprises.
4.2 Monthly services (such as social media management, advertising, SEO, etc.) are billed at the beginning of each month and are due within the first 5 business days.
4.3 One-time projects (like web development or branding) require a 50% deposit to get started, with the remaining 50% due upon completion.
4.4 Late payments may incur a 5% monthly fee on outstanding balances.
4.5 If payments are more than 15 days overdue, we may need to pause services until everything is up to date.
5. Cancellation Policy
5.1 Recurring Monthly Services
You may cancel monthly services with at least 30 days written notice sent to info@elevareagency.ca. Please note that payments for the current billing period are non-refundable.
5.2 One-Time Projects
The initial 50% deposit is non-refundable once work has begun. If a project is canceled midway, we’ll invoice only for the work completed up to that point.
5.3 Termination by Elevare Agency
In rare cases, we may need to terminate a collaboration with same-day notice if these terms are not respected, payments are not made, or circumstances arise that affect the integrity of the work.
6. Intellectual Property
6.1 All content we create (including text, designs, creatives, and code) remains the property of Elevare Agency until full payment has been received.
6.2 Once payment is complete, ownership of the materials created specifically for you is transferred to you, excluding our internal tools, templates, and processes.
6.3 You confirm that any materials you provide (such as logos, images, or text) are yours to use and share with us.
7. Confidentiality
We value trust. Both parties agree to keep any sensitive information shared during the collaboration confidential. We will never share your information without your consent, unless legally required.
8. Limitation of Liability
8.1 While we are committed to delivering the best possible results, we cannot guarantee specific outcomes (such as sales, leads, rankings, or follower growth), as these depend on factors beyond our control.
8.2 In any case, our maximum liability will not exceed the amount you’ve paid in the last 2 months of service.
8.3 We are not responsible for indirect losses, such as loss of revenue or other consequential damages.
9. Client Responsibilities
To ensure the best results, we ask that you provide the necessary information, access, and materials on time, review deliverables promptly, and assign a main point of contact for communication. Delays caused by missing information or feedback may affect timelines.
10. Publicity and Portfolio
We may showcase the work we create together in our portfolio, website, or marketing materials. If you’d prefer we don’t, just let us know in writing, we’ll absolutely respect that.
11. Governing Law
These Terms are governed by the laws of the Province of New Brunswick and the applicable federal laws of Canada. Any disputes will be handled in the courts of New Brunswick.
12. Modifications
We may update these Terms from time to time. If we do, we’ll notify you at least 15 days in advance via email. Continuing to use our services after that means you accept the updated version.
